This is a fuck-up on a number of levels. One, it's legal in Texas to spank your children, so long as you do not use any instrument to do it (ie, you cannot use a belt) or leave bruises. So the judge apparently acted in contravention of state law.
ReplyDeleteTwo, CPS is out of control. I've been saying that since I was in high school. The system is broken. Until their funding is no longer at all based on putting children into foster care and/or putting parents into "services", shit like this will continue.
Three, you have, again, an issue of a relative reporting someone in their family, which a large portion of the time seems to be an act of revenge/harassment. Even if there's nothing to the report, it will be considered part of a "history" with the agency and be counted against the parent. Meanwhile the person filing the false report never faces repercussions for it. (And it's also illegal for the agency to inform parents of their accuser.)
If it makes you feel any better, the issue isn't restricted to Texas. It's nationwide, near as I can tell.
